Terms of Service

These Terms of Service ("Terms") govern your use of SmartVind's vending machine services. By using our services, you agree to these Terms.

1. Service Description

SmartVind provides modern touchscreen vending machines stocked with snacks, beverages, and grab-and-go items. We handle installation, restocking, maintenance, and customer support for approved locations in Quebec.

2. Eligibility and Approval

Machine placement is subject to approval based on:

  • Location suitability and foot traffic
  • Electrical and space requirements
  • Agreement to allow SmartVind exclusive vending rights at the location

3. Customer Responsibilities

Location hosts agree to:

  • Provide adequate space and electrical access for the machine
  • Ensure safe access for restocking and maintenance
  • Not interfere with machine operation or pricing
  • Notify SmartVind promptly of any damage or issues

4. Pricing and Payment

All product prices are displayed on the machine and charged at the time of purchase. Payments are processed via debit, credit, or contactless methods. SmartVind reserves the right to adjust pricing at any time.

5. Refunds and Customer Support

If a customer experiences an issue with a purchase (incorrect charge, product not dispensed, etc.), they should contact SmartVind directly using the contact information displayed on the machine. Refunds are processed within 24 hours of verification.

6. Maintenance and Repairs

SmartVind is responsible for all maintenance, repairs, and restocking. Location hosts are not responsible for machine upkeep. Any damage caused by intentional misuse or vandalism may result in liability for the responsible party.

7. Termination

Either party may terminate the service agreement with 30 days' written notice. SmartVind will remove the machine and settle any outstanding matters upon termination.

8. Limitation of Liability

SmartVind is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid for the affected transaction.

9. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes will be resolved in the courts of Quebec.
